1. Introduction

This Privacy Policy (“Policy”) describes how Arlo Skye, Inc. (“Arlo Skye,” “we,” “our,” or “us”) collects, uses, discloses, and otherwise processes personal information in connection with our website at arloskye.com (the “Site”), our mobile applications, and all other online services that link to this Policy (collectively, the “Services”). Arlo Skye, Inc. is a Delaware C corporation with its principal place of business in Miami, Florida.

By using our Services, you acknowledge that you have read and understood this Policy. If you do not agree with our practices, please do not use our Services.

For California Residents: Please review Section 10 (“Your Privacy Rights – California”) for important disclosures required under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”).

2. Personal Information We Collect

2.1 Information You Provide Directly

We collect personal information you voluntarily provide to us, including when you:

  • Account Registration: Name, email address, password, and other account credentials.
  • Purchases: Name, email address, shipping address, billing address, phone number, and payment information (processed by our third-party payment processor; we do not store full credit card numbers).
  • Communications: Information you provide when contacting customer service, submitting product reviews, participating in surveys, subscribing to our newsletter, or using any interactive feature on our Site.
  • Referrals: If you use our referral program, we collect the name and email address of the person you refer. We use this information solely to send a one-time referral communication.

2.2 Information Collected Automatically

When you access or use our Services, we and our service providers automatically collect certain information, including:

  • Device and Usage Data: IP address, browser type and version, operating system, device identifiers, referring/exit URLs, pages viewed, date/time stamps, clickstream data, and other standard server log information.
  • Location Data: Approximate geographic location inferred from your IP address.
  • Cookies and Tracking Technologies: We use cookies, pixels (web beacons), and similar technologies as described in Section 7 (“Cookies and Tracking Technologies”) below.

2.3 Information from Third Parties

We may receive personal information about you from third-party sources, including data analytics providers, advertising networks, social media platforms, and data brokers. We may combine this information with information we collect directly from you.

3. How We Use Your Personal Information

We use personal information for the following business and commercial purposes:

  • Fulfill orders, process payments, and deliver products

  • Send transactional communications (order confirmations, shipping updates, account notifications)
  • Send marketing communications (with your consent or as permitted by applicable law)
  • Personalize your experience and deliver targeted advertising

4. How We Share Your Personal Information

Arlo Skye does not sell your personal information for monetary consideration. However, we share certain data with advertising partners for targeted advertising, which may constitute “sharing” under the CCPA and similar state privacy laws. See Section 10 for details on your opt-out rights.

We may disclose your personal information to the following categories of recipients:

  • Service Providers: Third parties that perform services on our behalf under written contracts, including payment processing, order fulfillment, shipping, email marketing (Klaviyo), website hosting (Shopify), analytics, customer service, and fraud prevention.
  • Advertising Partners: Third-party advertising and analytics companies — including Google, Meta, X (formerly Twitter), Pinterest, and Microsoft — that collect information through cookies and similar technologies on our Services for targeted advertising and analytics. We may add additional advertising partners in the future. This activity may constitute “sharing” under the CCPA.
  • Wholesale and Retail Partners: Authorized retailers that sell Arlo Skye products, to the extent necessary for order fulfillment and customer service.
  • Legal and Safety: When required by law, subpoena, court order, or government request; to protect the rights, property, or safety of Arlo Skye, our customers, or others; or to detect, prevent, or address fraud or security issues.
  • Business Transfers: In connection with any merger, acquisition, financing, reorganization, bankruptcy, or sale of company assets, your personal information may be transferred as part of that transaction.

5. Data Retention

We retain your personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. Specific retention periods include:

  • Account information: For the duration of your account plus 3 years following account closure or last activity.
  • Transaction records: 7 years from the date of the transaction (for tax, accounting, and warranty purposes).
  • Marketing communications data: Until you unsubscribe, plus a record of your opt-out preference.
  • Cookies and tracking data: As described in our cookie disclosures, typically 13 months or less for analytics cookies.
  • Legal hold data: As required to comply with legal obligations, resolve disputes, and enforce agreements.

6. Security of Your Information

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (TLS/SSL), access controls, and regular security assessments. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

If we become aware of a security breach that is reasonably likely to have compromised your personal information, we will notify you in accordance with applicable law.

7. Cookies and Tracking Technologies

Our Services use cookies, pixels, web beacons, and similar tracking technologies. These technologies serve the following purposes:

  • Strictly Necessary: Essential for website functionality, including shopping cart operation, account authentication, and security.
  • Analytics and Performance: Help us understand how visitors interact with our Site, including page views, traffic sources, and user behavior. We use Google Analytics and similar tools for this purpose.
  • Advertising and Targeting: Used to deliver relevant advertisements and measure ad campaign effectiveness. These may include pixels and tracking technologies from advertising platforms such as Google Ads, Meta (Facebook/Instagram), X (formerly Twitter), Pinterest, and Microsoft Advertising.

Your Cookie Choices: You may manage your cookie preferences through our cookie consent banner displayed when you first visit our Site, or at any time by adjusting your browser settings. You may also opt out of interest-based advertising through the Network Advertising Initiative or the Digital Advertising Alliance. To opt out of Google Analytics specifically, visit Google’s opt-out page.

Please note that disabling certain cookies may affect the functionality of our Services. Cookie-based opt-outs are browser and device specific.

8. Third-Party Links and Services

Our Services may contain links to third-party websites, applications, or services that are not owned or controlled by Arlo Skye. This Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party service before providing your information. We are not responsible for the privacy practices of third parties.

9. Children’s Privacy

Our Services are not directed to children under the age of 16. We do not knowingly collect, use, or disclose personal information from children under 16. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at privacy@arloskye.com. If we learn that we have collected personal information from a child under 16 without parental consent, we will promptly delete such information.

We do not sell or share the personal information of consumers we know to be under 16.

10. Your Privacy Rights – California

This section applies to California residents and supplements the information in this Policy with disclosures required under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”).

In the preceding 12 months, we have collected, used, disclosed for a business purpose, or shared for cross-context behavioral advertising the following categories of personal information:

10.2 Your California Rights

As a California resident, you have the following rights under the CCPA:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share your information.
  • Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions.
  • Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt-Out of Sale/Sharing: You may opt out of the “sharing” of your personal information for cross-context behavioral advertising by clicking the “Do Not Sell or Share My Personal Information” link in our website footer or by emailing privacy@arloskye.com. Arlo Skye does not sell personal information for monetary consideration.
  • Right to Limit Use of Sensitive Personal Information: You may limit the use and disclosure of your sensitive personal information to what is necessary to perform our services.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

10.3 How to Exercise Your Rights

To submit a request, please contact us at privacy@arloskye.com with the subject line “Privacy Rights Request.” We will verify your identity before processing your request. You may designate an authorized agent to submit requests on your behalf by providing written authorization.

We will respond to verifiable consumer requests within 45 days. If we require additional time (up to 90 days total), we will notify you of the extension and the reason.

10.4 Financial Incentives

We may offer financial incentives such as discounts or promotional offers in exchange for the collection or retention of your personal information (e.g., a discount for subscribing to our newsletter). Participation is voluntary, and you may withdraw at any time by unsubscribing. The value of the incentive is reasonably related to the value of your personal information to us, calculated based on the revenue generated from marketing communications.

10.5 “Do Not Track” / Global Privacy Control

Our Services recognize the Global Privacy Control (GPC) signal. If your browser transmits a GPC signal, we will treat it as a valid opt-out of the sharing of personal information associated with that browser. We do not currently respond to other “Do Not Track” signals, as there is no industry-accepted standard for such signals.

10.6 California “Shine the Light”

Under California Civil Code Section 1798.83, California residents may request a list of the categories of personal information disclosed to third parties for their direct marketing purposes during the preceding calendar year and the names and addresses of those third parties. To make such a request, contact us at privacy@arloskye.com.

11. Your Privacy Rights – Other U.S. States

Residents of Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Utah, Florida, Indiana, Kentucky, Rhode Island, and any other state with an applicable comprehensive privacy law may have similar rights, including the rights to:

  • Access, correct, and delete your personal information
  • Opt out of the processing of your personal data for targeted advertising, sale, or profiling in furtherance of decisions that produce legal or similarly significant effects
  • Obtain a copy of your personal data in a portable format
  • Appeal our decision regarding a privacy request

To exercise these rights, contact us at privacy@arloskye.com with the subject line “Privacy Rights Request.” If we decline your request and you wish to appeal, you may contact us with the subject line “Privacy Rights Appeal.” If your appeal is denied, you may contact the attorney general in your state of residence.

We do not process personal information for the purpose of profiling consumers in furtherance of decisions that produce legal or similarly significant effects.

12. International Users

Our Services are primarily intended for users in the United States. If you access our Services from outside the United States, please be aware that your personal information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, our legal basis for collecting and using your personal information is your consent, the performance of a contract with you, or our legitimate interests (such as fraud prevention and improving our services), as appropriate. You may have additional rights under the General Data Protection Regulation (GDPR), including rights of access, rectification, erasure, data portability, restriction of processing, and objection to processing. 13. SMS/Text Message Communications

Arlo Skye does not currently send marketing or promotional text messages (SMS or MMS). If you previously opted in to receive text messages from us for marketing purposes, we have discontinued that program.

You may opt in to receive transactional or service-related text messages (such as order confirmations, shipping updates, delivery notifications, or fraud alerts) through the Shopify checkout process. These messages are not marketing communications and are sent solely to fulfill or support your transaction. You may opt out of transactional text messages at any time by replying STOP or by adjusting your notification preferences in your account settings.

Texas Residents: In compliance with Texas Senate Bill 140, which expanded the Texas Business & Commerce Code to regulate marketing text messages effective September 1, 2025, Arlo Skye does not send marketing text messages to Texas phone numbers. We do not collect phone numbers from Texas residents for marketing purposes. Transactional messages related to an existing purchase are not marketing communications under SB 140.

If you receive a text message from us that you believe is marketing in nature, please contact us at privacy@arloskye.com and we will promptly investigate and resolve the issue.

14. User-Generated Content

If you submit content to publicly accessible areas of our Services (such as product reviews), that content may be visible to other users and the public. We are not responsible for the privacy of any information you choose to make public. Please exercise caution before disclosing personal information in public forums.

15. Changes to This Policy

We may update this Policy from time to time. When we make material changes, we will notify you by posting the updated Policy on our Site with a revised “Last Updated” date. Where required by law, we will provide additional notice (such as by email). Your continued use of our Services after any changes constitutes your acceptance of the updated Policy.
